COUNCIL REVIEW OF PLANNING COMMISSION DECISION CONCERNING <br /> PROPERTY IN THE GOFF ADDITION AS REQUESTED BY ATTORNEY <br /> GARY VINSON <br /> Mr. Gary Vinson addressed the council in regards to a planning commission <br /> decision stating that the property that he and Chris Anderson bought and divided up into <br /> 3 lots constitutes a subdivision and therefore they must conform to subdivision <br /> regulations. Mr. Vinson said that the 150 feet of Chadwick is a private drive and not a <br /> public street and has not been dedicated to the City as such. According to maps, the <br /> street is platted but Mr. Charles Goff said the City never accepted that 150 foot portion of <br /> Chadwick Street. Pat and Bruce Rutherford addressed the council and ask them to <br /> uphold the planning commissions decision. They said that there was not a problem with <br /> that portion of Chadwick when there was only one house at the end but now there are 4 <br /> houses and a lot of traffic. The traffic creates lots of dust. According to the city code, if <br /> a parcel of land is sold and divided into 2 or more lots, that constitutes a subdivision. <br /> After a lengthy discussion, Councilmember Cargill moved to table the issue until the next <br /> council meeting to allow the council to walk the area to get a better idea of the issue. <br /> Councilmember Gaither seconded and all voted for. <br /> POSSIBLE CONSIDERATION OF PUBLIC FACILITIES BOARD FOR <br /> RECREATION <br /> Dr. Bill Beller presented the council with an ordinance that would create a <br /> Recreational Facilities Board for the City of Batesville. Councilmember Watkins <br /> introduced the ordinance and Mayor Biard read it in full. After several questions from <br /> the council on the purpose of the board, Councilmember Pectol moved to suspend the <br />
