MINUTES OF COUNCIL <br /> FEBRUARY 24, 2004 <br /> The Batesville City Council met in regular session on February 24, at 5:30 PM at <br /> the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember <br /> Ford gave the invocation. Upon roll call the following Councilmembers answered <br /> present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry <br /> Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston <br /> and the City Attorney Scott Stalker. <br /> Councilmember Ford moved to approve the minutes from the last meeting. <br /> Councilmember Gaither seconded and all voted for. <br /> Councilmember Ford moved to approve the prepared agenda. Councilmember <br /> Gaither seconded and all voted for. <br /> CONSIDER SETTING WATER METER OUTSIDE CITY LIMITS <br /> Mr. Larry Tharnish with the Batesville Water Utility addressed the council with a <br /> request to set a water meter outside the city limits. Mr. Marlin Ivy on 300 Hunter Springs <br /> Road has requested the meter. Councilmember Gaither made the motion to set the meter <br /> and Councilmember Mitchum seconded. All voted for. <br /> CITY ATTORNEY OPINION REGARDING REQUEST FOR APPEAL ON <br /> DECISION BY CITY PLANNING COMMISSION <br /> City Attorney Scott Stalker addressed the council regarding a request from Mr. <br /> Gary Vinson to appeal a Planning Commission ruling to the City Council. Mr. Stalker <br /> said that the city code book regarding sub-division had no appeal process, however, Mr. <br /> Stalker said because of the complicated issue, he was advising the council to hear the <br />
