MINUTES OF COUNCIL <br /> JULY 22, 2003 <br /> The Batesville City Council met in regular session on July 22, at 5:30 PM at the <br /> Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave <br /> the invocation. Upon roll call the following Councilmembers answered present: R.L. Carpenter, <br /> Robert Ford, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Councilmembers <br /> Gaither and Cargill were absent. Also present were the City Clerk Denise Johnston and the City <br /> Attorney Scott Stalker. <br /> Councilmember Ford moved to approve the minutes from the last meeting. <br /> Councilmember Watkins seconded and all voted for. <br /> Councilmember Ford moved to approve the prepared agenda as amended. <br /> Councilmember Watkins seconded and all voted for. <br /> SHERIFF'S REPORT <br /> Captain Bill Lindsey with the Independence County Sheriff's Department gave the <br /> council a monthly activities report. <br /> NOISE ORDINANCE WITHOUT EMERGENCY CLAUSE <br /> Mayor Biard read the ordinance for the third and final reading. The ordinance failed for <br /> the lack of a motion to adopt. <br /> CONSIDER NOISE ORDINANCE WITH EMERGENCY CLAUSE <br /> Mayor Biard read an ordinance regulating excessive loud noises by use of sound <br /> amplification systems from motor vehicles within the City of Batesville, declaring a penalty for <br /> violations and declaring an emergency. Councilmember Watkins moved to suspend the rules for <br /> the second and third reading and Councilmember Terrell seconded. The roll call count was 6 for <br /> and 0 against. Councilmember Watkins to adopt the ordinance and Councilmember Terrell <br />
