Page 17 <br /> 4 . 8 Wastewater Discharge Permit Decisions <br /> The Manager will evaluate the data furnished by the industrial <br /> user and may require additional information. Within ninety ( 90 ) days <br /> of receipt of all requested information and a completed wastewater <br /> discharge permit application, the Manager will determine whether or not <br /> to issue a wastewater discharge permit. If no determination is made <br /> within ninety (90 ) days, the application will be deemed denied. The <br /> Manager may deny any application for a wastewater discharge permit <br /> where the applicants requested discharge would violate any provision of <br /> this ordinance, or where, in the judgement of the Manager the discharge <br /> would adversely effect the operation of the POTW or cause the POTW to <br /> violate it 's NPDES permit. <br /> SECTION 5 - WASTEWATER DISCHARGE PERMIT ISSUANCE PROCESS <br /> 5 . 1 Wastewater Discharge Permit Duration <br /> Wastewater discharge permits shall be issued for a specified <br /> time period, not to exceed five (5 ) years. A wastewater discharge <br /> permit may be issued for a period less than five (5 ) years, at the <br /> discretion of the Manager. Each wastewater discharge permit will <br /> indicate a specific date upon which it will expire. <br /> 5 . 2 Wastewater Discharge Permit Contents <br /> Wastewater discharge permits shall include such conditions as <br /> are reasonable deemed necessary by the Manager to prevent a violation <br /> of the city's NPDES permit and to prevent pass through or interference, <br /> protect the quality of the water body receiving the treatment plant's <br /> effluent, protect worker health and safety, facilitate sludge <br /> management and disposal, protect ambient air quality, and protect <br /> against damage to the POTW. <br /> A. Wastewater discharge permits must contain the following <br /> conditions: <br /> ( 1) A statement that indicates wastewater discharge permit <br /> duration, which in no event shall exceed 5 years. <br /> (2 ) That the wastewater discharge permit is nontransferable <br /> without prior notification to [and approval from the <br /> Batesville Utilities Commission] , and provisions for <br /> furnishing the new owner or operator with a copy of the <br /> existing wastewater discharge permit. <br /> ( 3 ) Effluent limits applicable to the user based on <br /> applicable standards in Federal, State, and local law. <br /> (4 ) Self monitoring, sampling, reporting, notification, and <br /> • record keeping requirements. These requirements shall <br /> include an identification of pollutants to be <br /> monitored, sampling location, sampling frequency, and <br /> sample type based on Federal, State, and local law. <br />
