(W <br /> BEFORE THE CITY COUNCIL <br /> FOR THE CITY OF BATESVILLE, ARKANSAS <br /> PETITION TO VACATE STREET <br /> The undersigned, owners of Lots 7 and 8, Block 6, and <br /> Lots 1 and 10, Block 7 of Quail Valley Addition to the City of <br /> Batesville , Arkansas , as shown by Plat recorded in Book M-11, page <br /> 623 of the Independence County Records , hereby Petition the City <br /> Council for the City of Batesville, Arkansas , as follows : <br /> 1 . That Finch Street, as shown by the Plat recorded <br /> as set out above, a true copy of which is attached, is a fifty ( 50 <br /> foot unopened street which runs between Lots 7 and 8 of Block 6 <br /> and Lots 1 and 10 of Block 7 of Quail Valley and between Lots 7 <br /> and 8, Block 4 and Lots 1 and 10 of Block 5. <br /> 2. That Kimmswick Corporation, the owner of more than <br /> fifty percent (50% ) of the lots in Quail Valley Addition to the <br /> City of Batesville, Arkansas , and authorized by the Deed of <br /> Dedication and Bill of Assurance, as amended, of Quail Valley <br /> Addition to amend the Bill of Assurance has now caused a replat <br /> of Lot 1, 6 thru 10 of Block 5; Lots 7 thru 10, Block 4; Lots 3 <br /> thru 7 and 8 thru 13 of Block 6; all of Block 7; and Lot 1, 5 thru <br /> 12 of Block 8 to be prepared by Miller-Newell Engineers , Ltd. , <br /> registered surveyors ; that a true copy of said plat is attached <br /> hereto . <br /> 3. That in said replat, Robin Street is extended fully <br /> so that it connects with Rutherford Road, and becomes a through <br /> street; that because of this there is no reason for the continued <br /> ex1tence of Finch Street . <br /> 4 . That the public interest and welfare of the City of <br /> Batesville will not be adversely affected by the vacation of <br /> Finch Street. <br /> 5. That the Petitioners herein are all of the land- <br /> owners of the lots abutting the street to be vacated. <br />
