ORDINANCE NO.,5:P2615- <br /> AN ORDINANCE RESTRICTING THE USE OF EQUINE ON CERTAIN CITY <br /> STREETS DURING CITY CHRISTMAS LIGHTS DISPLAYS AND <br /> AUTHORIZING CITY CODE ENFORCEMENT TO SET STANDARDS FOR <br /> CARRIAGE RIDES <br /> WHEREAS, the City of Batesville is renowned for its annual Christmas <br /> lights which are displayed through approximately mid-November through early <br /> January; <br /> WHEREAS,, said annual display increases traffic congestion on certain <br /> streets which include: Main Street west of its intersection with St. Louis Street; <br /> Chaney Drive; 20th Street south of its intersection with Harrison Street; Meyers <br /> Street; and Pioneer Drive; <br /> WHEREAS,, that Batesville annually grants a temporary use permit to a <br /> horse carriage company to operate within the city during the Christmas lights <br /> display; <br /> WHEREAS., that Batesville City Code Enforcement currently grants said <br /> temporary use permits and should be allowed to set the standards for said <br /> permit in such a way as to promote the free flow of traffic, order, and safety <br /> within the city; <br /> WHEREAS,, that because equine on city streets slow the flow of traffic <br /> and increase potential dangers to pedestrians and other traffic in an already <br /> congested area, their use should be limited to those who have been granted a <br /> conditional use permit from the city on these designated streets or are <br /> participating in a parade so designated by the Mayor of the city; <br /> WHEREAS,, that because the Christmas lights are currently being <br /> displayed the need to ban equine from certain streets is immediate; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE,, ARKANSAS: <br /> Section 1. That with the exception of those granted a conditional use <br /> permit by Batesville City Code Enforcement or are participating in a parade so <br /> designated by the Mayor of the City of Batesville, equine are banned from <br /> November 15 of each year through January 10 of the following year on the these <br /> designated streets: Main Street west of its intersection with St. Louis Street; <br /> Chaney Drive; 20th Street south of its intersection with Harrison Street; Meyers <br /> Street; and Pioneer Drive; <br />
