NOW, THEREFORE, BE IT ORDAINED that the City of Batesville, <br />Arkansas fixes and establishes that: <br />(1) domestic type wastewaters are defined by <br />1 <br />Batesville City Ordinance No. 905 as those which are <br />I <br />shown to exhibit strength characteristics not <br />exceeding 270 mg/l biochemical oxygen demand (BOD), <br />'4 <br />270 mg/1 suspended solids, at any hydraulic flow <br />rate, or exhibiting any other characteristics which <br />i' <br />i <br />are not normally constituents of domestic wastewater; <br />(2) any industrial or commercial user which <br />i. <br />discharges wastes into the Batesville Wastewater <br />System in excess of 50,000 gallons per day, whether <br />'! equalized or not, and the characteristics of same <br />wastes may be less than those defined above in (1) <br />i <br />shall likewise pay the Industrial Cost Recovery <br />;i <br />ii <br />Charge as delineated hereinafter; <br />j <br />(3) the discharge characteristics of any <br />industrial or commercial customer exceeding the <br />j <br />ii limits previously stipulated in either (1) and/or <br />(2) above shall pay an industrial cost recovery <br />charge based on its pro --rata share of the capital <br />costs of construction of the Batesville Wastewater <br />1. <br />Pumping and Treatment System in addition to thF: <br />i <br />normal monthly sewer user charge. <br />(4) any industrial concern whose hydraulic, <br />i <br />chemical, or biochemical characteristics do not <br />exceed the previously defined limits of (1) and/or <br />i� <br />(2) above will not be required to pay industrial <br />cost recovery charges; <br />(5) the industrial cost recovery charge as <br />applied initially to existing industries will be <br />ii modified and redistributed as additional qualifying <br />ii industries are connected to the wastewater system <br />and as a minimum for all industrial users on a <br />i' <br />yearly basis; <br />i! <br />- 2 - <br />
