Anything herein to the co=ary not,%7itt�st_aigcling, no <br />default (other than a default under Section 1001 (a), N) a._d (c) !,ercof to ,v�_ic�I this <br />Section 1013 shall not be applicable) shall constitute an event of default until <br />actual notice of such default by registered or certified mail (,,,jith or without return <br />receipt requested) shall be given to the Lessee under the Lease Agreement, and the <br />Lessee under the Lease Agreement shall have had sixty (60) days after receipt of <br />such notice to correct said default or cause said default to be corrected, and the <br />Lessee under the Lease Agreement shall not have corrected said default or caused <br />said default to be corrected within said sixty (60) days period; provided, how- <br />ever, if said default be such that it cannot be corrected within sixty (60) days, <br />it shall not constitute an event of default if corrective action is instituted within <br />said sixty (60) days period and diligently pursued until the default is corrected. <br />With regard to any alleged default concerning which notice is given to the Les- <br />see under the Lease Agreement under the provisions of this Section 1013, the <br />City names and appoints the Lessee under the Lease Agreement as its attorney <br />in fact and agent with full authority to perform any covenant or obligation of <br />the City alleged in said notice to constitute a default in the name and stead of <br />the City with full power to do any such things and acts to the same extent that <br />the City could do and perform any such things and acts and with power of substi- <br />tution. In this regard, it is agreed that the parties hereto have familiarized them- <br />selves with the 'terms and provisions of the Lease Agreement. <br />Section 1014. The rights and remedies provided in favor of the <br />Trustee and the holders of the bonds by the provisions of this Indenture are in each <br />case subject to the proviso that each and every such right and remedy shall be and <br />may be exercised only subject and subordinate to the rights of said Lessee under <br />the Lease Agreement. <br />
