CM <br />the Trustee as his, their or its agent or attorney-in-fact with full power and <br />authority, to the extent authorized.. by lave, to do all acts and things and <br />exercise all discretion authorized or permitted by him, them or it, for and <br />on behalf of him, them or it and in his, their or its name. In case any <br />separate trustee or co -trustee shall die, become incapable of acting, <br />resign or be removed, all the estates, properties, rights, powers, trusts, <br />duties and obligations of said separate trustee or co -trustee, so far as <br />permitted by law, shall vest in and be exercised by the Trustee until the <br />appointment of a new trustee or a successor to such separate trustee or <br />co -trustee. <br />Section 1115. Any bank or trust company with or into which the <br />Co -Paying Agent may be merged or consolidated, or to which the assets and business <br />of such Co -Paying Agent may be sold, shall be deemed the successor of such <br />Co -Paying Agent for the purposes of this Indenture. If the position of Co -Paying <br />Agent shall become vacant for any reason, the City may, within thirty (30) <br />days thereafter appoint a bank or trust company as Co -Paying "Igent to fill such <br />vacancy; provided, however, that if the City shall fail to appoint such Co -Paying <br />Agent within said period, the Trustee may make such appointment. It shall not <br />be mandatory that any vacancy in the position of Co -Paying Agent be filled. <br />
