Section 2. That Multi-Craft Contractors, Inc. was contracted to perform the <br /> • necessary repairs in the most expedient manner available. That Multi-Craft <br /> Contractors, Inc., is qualified and capable of performing the highly specialized <br /> system and electrical repairs required. <br /> Section 3. That said contract was initially to be in the amount of <br /> approximately $300,000.00 more or less, based on the estimate currently available <br /> at the time. <br /> Section 4. That the contract specifications need to be revised in order to <br /> account for replacement of one major control system, as well as all pump and tank <br /> controls, and those revisions have resulted in a material increase of the contract <br /> amount, requiring Council approval. <br /> Section 5. That said contract, with revised specifications, will be in the <br /> amount of approximately $600,000.00 more or less, based on the current estimate. <br /> Section 6. That, since competitive bidding is not feasible or practical <br /> because of the immediate need for the repairs, which are ongoing, as well as the <br /> specific and unique nature of the repairs, the City Council in accordance with the <br /> terms of Ark. Code Ann. § 14-58-303(b)(2)(B) hereby waives the bidding <br /> requirements and directs the City of Batesville Water Department to enter into the <br /> • above described contract for on or about the price set forth in Section 5 above. <br /> Section 7. EMERGENCY CLAUSE: It is further found that due to the <br /> immediate need to acquire the above described services, an emergency is declared <br /> to exist and this ordinance being necessary for the preservation of the public peace, <br /> health and safety shall take effect from and after its passage and approval. <br /> PASSED AND APPROVED this 27`h day of November, 2012. <br /> Ho rable umbaugh, Mayor <br /> ATTEST: <br /> Denise M.
