ORDINANCE NO. <br />AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR <br />OTHER PURPOSES. <br />WHEREAS, the Batesville Planning Commission received a request to rezone property on <br />Harrison Street, identified by the Independence County Assessor as parcel number 11003770016; and <br />WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing <br />on August 7, 2023 to hear public comment about the proposed zoning revision; and, <br />WHEREAS, the Batesville Planning Commission, at its regular meeting on August 7, 2023, has <br />determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan, as <br />amended, and is in the best interest of the future development of the city; and, <br />WHEREAS, the Batesville Planning Commission at the same regular meeting, determined that <br />the adjacent parcel at 3030 Harrison Street, identified by the Independence County Assessor as parcel ID <br />1100377000E and owned by the City of Batesville, would thereby become an isolated R-1 zoning district <br />inconsistent with the Batesville Comprehensive Plan and unlikely to ever be use or available for <br />residential use and should therefore also be rezoned from R-1 to C-1; and, <br />WHEREAS, the Batesville Planning Commission has recommended that the requested <br />amendments to the Zoning Districts map be approved by the City Council. <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />BATESVILLE, ARKANSAS: <br />Section 1. The Batesville Zoning Districts Map is hereby amended from Single Family Residential (R-1) <br />to Commercial Community District (C-1) for properties identified by the Independence County Assessor <br />as parcels] 1003770016 and 1100377000E. <br />SECTION 2.
