(i) non-ferrous metals; <br /> (ii) plastic and polymer-based products (including polyvinylchloride, <br /> composite building materials,and polymers used in fiber optic cables) <br /> (iii) glass(including optic glass); <br /> (iv) lumber;or <br /> (v) drywall <br /> (2) Domestic content procurement preference. <br /> (a) This award term and condition implements P.L. 117-58, Build America, Buy <br /> America Act§§70901-52,by requiring that all iron,steel,manufactured products, <br /> and construction materials used for a project for the construction, alteration, <br /> maintenance or repair of a public water system or treatment work are produced <br /> in the United States except as provided in paragraph (2)(b) and (2)(c) of this <br /> section and condition. <br /> (b) This requirement does not apply with respect to a project if funds were secured <br /> prior to May 14,2022. <br /> (c) This requirement shall not apply in any case or category of cases in which the <br /> Administrator of the Environmental Protection Agency finds that:— <br /> (i) applying the domestic content procurement preference would be <br /> inconsistent with the public interest; <br /> (ii) types of iron,steel,manufactured products,or construction materials are not <br /> produced in the United States in sufficient and reasonably available <br /> quantities or of a satisfactory quality;or <br /> (iii) the inclusion of iron and steel, manufactured products, or construction <br /> materials produced in the United States will increase the cost of the overall <br /> project by more than 25 percent. <br /> (3) Request for a Waiver under(2)(c). <br /> (a) Any recipient request to use foreign iron or steel products in accordance with <br /> paragraph(2)(c) of this section shall include adequate information for Federal <br /> Government evaluation of the request,including— <br /> (1) Waiver type; <br /> (2) Recipient Name and Unique Entity Identifier(UEI); <br /> (3) Financial assistance listing name and number; <br /> (4) Federal financial assistance program name; <br /> (5) Federal Award Identification Number(FAIN)(if available) <br /> (6) Federal financial assistance funding amount; <br /> (7) Total cost of infrastructure expenditures, including all Federal and <br /> non-Federal funds(to the extent known); <br /> (8) Infrastructure project description and location(to extent known); <br /> D-7 <br />
