(9) List of iron or steel item(s), manufactured products, and construction <br /> materials proposed to be excluded from Buy America requirements, <br /> including name, cost,country(ies)of origin(if known), and relevant PSC <br /> and NAICS codes for each; <br /> (10) A description and detailed justification for use of the foreign iron, steel, <br /> manufactured product(s),or construction material(s); <br /> (11) A certification that the recipient made a good faith effort to solicit bids for <br /> domestic products supported by terms included in requests for proposals, <br /> contracts,and nonproprietary communications with the prime contractor <br /> (12) A statement of waiver justification,including a description of efforts made <br /> (e.g.,market research,industry outreach),by the Federal awarding agency <br /> and,and in the case of a project or award specific waiver,by the recipient, <br /> in an attempt to avoid the need for a waiver.Such a justification may cite, <br /> if applicable,the absence of any Buy America-compliant bids received in <br /> response to a solicitation. <br /> (13) Anticipated impact if no waiver is issued; <br /> (14) Any relevant comments received during the public comment period. <br /> (b) If the Administrator receives a request for a waiver under this section,the waiver <br /> request shall be made available to the public for at least 15 days prior to making <br /> a finding based on the request. <br /> (c) Unless the Administrator issues a waiver of this term,use of foreign iron, steel, <br /> manufactured product(s),or construction material(s)is noncompliant with P.L. <br /> It 7-58 Section 70914 of the Build America,Buy America Act. <br /> (d) This term and condition shall be applied in a manner consistent with United States <br /> obligations under international agreements. <br /> S_annee <br /> The Borrower agrees to comply with the 2015 SRF Signage Guidance in order to enhance public <br /> awareness of EPA assistance agreements nationwide. Projects that receive BIL funding must <br /> follow the BIL specific signage term and conditions.The BIL signage term and condition requires <br /> a physical sign displaying the official Building a Better America emblem and EPA logo be placed <br /> at construction sites for BIL-funded projects. For the Clean Water and Drinking Water SRF <br /> programs,this requirement applies only to the following projects: <br /> • Construction projects identified as"equivalency projects"for BIL general supplemental <br /> capitalization grants. <br /> • Construction projects that receive additional subsidization (grants or forgivable loans) <br /> made available by BIL general supplemental capitalization grants. <br /> • All construction projects funded with BIL emerging contaminants capitalization grants. <br /> • All construction projects funded with BIL lead service line replacement capitalization <br /> grants. <br /> D-8 <br />
