Street, residential, local means a street designed to provide circulation within a residential subdivision <br /> and to individual lots, and function to serve as the access to abutting, private properties and access to the <br /> higher functional classified streets. <br /> Structure means anything constructed or erected or installed by man, the use of which requires more or <br /> less permanent location on the ground or attached to something, or attached to something having a <br /> permanent location on the ground,including but not limited to buildings,towers and smokestacks. <br /> Subdivider means any person or any other group or combination acting as a unit,dividing or proposing to <br /> divide land so as to constitute a subdivision and includes any agent of the subdivider. <br /> Subdivision means all divisions or platting of a tract or parcel of land into two or more lots, building sites <br /> or other divisions for the purpose,whether immediate or future,of sale or building development and shall <br /> include all divisions of land involving the need for new access, a new street or a change in existing <br /> streets;provided however,that the following shall NOT be considered a subdivision: <br /> (1) The combination or recombination of previously platted lots where the total number of lots is not <br /> increased and the resulting lots are equal to or exceed the development standards of the city; <br /> (2) The division of land into parcels greater than five (5) acres provided each newly created lot or <br /> parcel has minimum lot frontage on legal and physical access, <br /> (3) Transfers of interest by will or pursuant to court order or mortgages, <br /> • (4) The public acquisition by purchase or dedication of parcels of land for the widening or opening <br /> of streets or other public improvements. <br /> Surveyor means a professional land surveyor registered in the state. <br /> Vehicular access easement means a vehicular easement authorized by the planning commission to <br /> provide primary access in hillside areas and not more than 300 feet in length nor serving more than five <br /> lots. <br /> Zero lot line development means a residential development concept eliminating the normally required side <br /> yard for one side,to provide for more usable open space on the other side. <br /> Section 15.02.02 Amendments <br /> This chapter may be amended at any time after the planning commission has held a public hearing on the <br /> proposed amendments. At any subsequent scheduled meeting of the planning commission following such <br /> public hearing,the planning commission may recommend to the city council the adoption of such <br /> amendments. <br /> Section 15.02.03. Types of subdivisions <br /> (a) Generally. Recognizing that subdivision regulations must be applied to various land development <br /> types, and because of the special conditions pertaining to each, this chapter provides for the <br /> • establishment of four subdivision types: commercial/office, industrial,planned unit development,and <br /> residential design. Standards applicable to each of these four types are outlined in this chapter. Prior <br /> to the approval of any preliminary plat, the planning commission shall classify and evaluate each <br /> subdivision according to its planned future use, it being the responsibility of the applicant to identify <br /> - 149 - Batesville Subdivision Regulations <br />
