conditions within the site and its vicinity to the staff. Submitted information shall convey the <br /> intentions of the subdivider as to the proposed layout and type of development. No fees shall be <br /> collected for preapplication review, its purpose being to acquaint the subdivider with plans and <br /> policies in effect that would be significant to the proposed subdivision. <br /> (b) Review of sketch plans. The preapplication procedure affords the subdivider the opportunity to obtain <br /> the advice and assistance of the staff early and informally in order to: <br /> (1) Assist the subdivider in analyzing the development plan. <br /> (2) Give informal guidance to the development at a stage when potential points of difference can <br /> be more easily resolved, thus simplifying official actions and saving unnecessary expense and <br /> delay to the subdivider. <br /> (3) Determine whether or not a combined preliminary and final plat procedure may be authorized <br /> under section 2.24. <br /> (c) Advice. Advice of the staff shall be provided in either verbal or written form, at the option of the <br /> subdivider, within 30 days of the sketch plan submittal. It is binding on neither the city nor the <br /> subdivider. <br /> Section 15.02.22. Preliminary Plat approval/notification <br /> (a) Application. Whenever a subdivision is proposed to be made or before sale of any lots located in the <br /> • subdivision as a whole or any part is made, or before building permits are approved for multiple <br /> building sites,the owner shall file a plan of the proposed subdivision with the planning commission <br /> for approval. The applicant shall submit all the necessary fees and meet all the submittal <br /> requirements at the time of the filing as described in section 2.24. <br /> (b) Notification. For nonresidential plats, in areas where zoning is not applicable, the applicant shall <br /> submit proof of written notice to all owners of land contiguous to the subdivision presented for <br /> approval. For residential plats, the applicant shall give written notice to all owners of unplatted <br /> tracts and all platted lots in excess of 2.5 acres contiguous to the subdivision presented for approval. <br /> For all owners of residential or nonresidential parcels landlocked and contiguous to the subdivision, <br /> notice shall be given. The procedure for such notice shall be as follows: Not less than ten days prior <br /> to the planning commission meeting, a written notification containing the time, place and date of the <br /> hearing shall be given. The notice shall be sent by certified or registered mail or a petition of <br /> notification circulated to the last known address of such record owner; and the petitioner shall <br /> execute and file with the staff an affidavit showing compliance with this chapter, attaching as <br /> exhibits to the affidavit official evidence that the notices have been so mailed or the petition <br /> circulated. <br /> (c) Staff review. <br /> (1) The staff and other appropriate city and public agency staff shall review the proposed <br /> subdivision for conformance with this chapter. In its review, staff shall take into consideration <br /> the requirements of the city and the use of the land being subdivided and may offer suggestions <br /> concerning changes they feel would enable the project to meet the purpose and intent of this <br /> • chapter. Particular attention shall be given to width, arrangement and location of streets; utility <br /> easements; drainage; lot sizes and arrangements; and other facilities such as parks,playgrounds <br /> or school sites, public buildings, parking areas, arterial streets and the relationship of the <br /> proposed subdivision to adjoining, existing,proposed and possible subdivision of lands. <br /> - 152 - Batesville Subdivision Regulations <br />
