• II <br /> (b) Review of the final plat. The staff shall review final plats for conformance with drainage and/or <br /> construction plans approved in conjunction with the preliminary plat. Comments will be forwarded <br /> to the planning commission for use in final plat review. <br /> (c) Approval. Responsibility for final plat approval shall reside with the planning commission, which <br /> body shall approve or disapprove the final plat within 30 days of its submittal unless the subdivider <br /> agrees in writing to a deferral. No final plat shall be approved until: <br /> (1) its conformance with the preliminary plat has been verified and the subdivider and the city <br /> have entered into an agreement assuring completion of all required improvements as specified <br /> in section 3.15; and, <br /> (2) the City Council has accepted the streets included in the plat, pursuant to the provisions of <br /> section 3.21. <br /> Approval of the final plat shall be accomplished subsequent to an affirmative vote of the planning <br /> commission when the chairman of the planning commission signs the certificate of final plat <br /> approval as shown in section 2.31 and all fees have been remitted as per section Section 2.6 above. <br /> (d) Denial, Any plat submitted for final plat approval not in conformance with the preliminary plat as <br /> determined by the planning commission shall be denied. If the final plat is denied, such decision <br /> shall be communicated to the subdivider in written form expressing the reasons within five days <br /> after such determination is made. <br /> • (e) Staging. The subdivider may, and in conformance with the provisions of section 2.3 1, seek final <br /> approval for only a portion of the property for which the preliminary plat was approved. For <br /> residential plats, however, such stages shall contain at least five percent(but in no case less than five <br /> lots)of the total number of lots contained within that phase of the approved preliminary plat seeking <br /> final plat approval. <br /> (f) Assurance of Completion Instrument. The planning commission may require that the assurance of <br /> completion instrument for the public improvements be in such amount as is commensurate with the <br /> stage of the plat being filed and may defer additional assurance of completion requirements until <br /> additional stages of the plat are offered for filing. (see Section 3.15.Assurance of Completion). <br /> Section 15.02.24. Combined preliminary and final plat procedure <br /> (a) Submission of combined application. Based upon the preapplication procedure and the requirements <br /> for minor subdivisions, lot splits and planned unit developments where no public purpose would be <br /> served by separate steps, a combined preliminary and final plat procedure may be authorized in the <br /> circumstances and in conformance with the requirements and standards specified in this section. <br /> (b) Minor subdivisions. <br /> (1) Authorization. The staff may authorize a combined preliminary and final review procedure for <br /> minor subdivisions. All plats submitted as minor subdivisions shall require review and approval <br /> by the planning commission. <br /> • (2) Review and approval. Request for minor subdivision approval shall be made by the owner of <br /> the land to the staff. Subdivision requirements shall be the same as those required for final plat. <br /> The planning commission shall review the plat. If the final plat is in conformance with the <br /> - 154 - Batesville Subdivision Regulations <br />
