• (1) Plot plan. Anticipated structures should be shown, to scale, on the plot plan as submitted for a <br /> building permit. <br /> (2) Community Mailboxes. Community Mailboxes shall be less than 44 inches high and 23 inches <br /> by 23 inches wide. Planters or decorative fixtures, to be attached to and made a part of the <br /> mailbox shall also be drawn to scale on the plot plan. <br /> (3) Permits. Permits for structures to be placed temporarily in the public right-of-way(i.e. building, <br /> sign, street cut,barricade,etc.)may also be required. <br /> (4) No liability for damage or destruction. The City of Batesville does not,by the enactment of this <br /> subsection, accept or acknowledge any liability or responsibility for damage or destruction of <br /> any structure heretofore or in the future existing in the right-of-way, regardless of age or <br /> duration of the structure, as a result of any work, including but not limited to, repairs, <br /> maintenance or expansion,in the right-of-way,performed in the past or the future. <br /> Section 15.03.03. Easements and Public riehts-of-way <br /> (a) Utility easements for poles, wires, conduits, storm sewers, sanitary sewers, gas lines, water mains <br /> and lines, and public rights of way for use as, or maintenance of, a street, crosswalk, railroad, or for <br /> similar purposes shall be provided where required by utilities or the city. Such easements shall not <br /> be less than five feet on either side of the rear lot lines and five feet on either side of the side lot <br /> lines. The specific location of easements not uniform in width and parallel to lot lines shall be shown <br /> by dimensions. The placement and dimensions for public rights of way shall be governed by the <br /> • master street plan and the determination of the classification of the street and of the resulting or <br /> necessary right-of-way. <br /> (b) No building or structure may be erected over or in an easement or public right-of-way other than a <br /> mailbox, driveway, sidewalk, pathway or alley without being subject to a fine and removal of the <br /> building or structure by the city at cost to the property owner. <br /> (c) All vehicular access easements shall be clearly indicated on the plat and properly dimensioned <br /> according to the requirements of this section. <br /> Section 15.03.04. Alleys <br /> Alleys may be allowed at the rear of as a means of providing secondary access and/or to provide off-street <br /> parking. <br /> Section 15.03.05. Lots <br /> (a) Every lot shall abut upon a public street except where private streets are explicitly approved by the <br /> planning commission. The size, shape and orientation of lots shall be appropriate for the location of <br /> the subdivision and for the type of development and use contemplated. <br /> (b) Minimum lot dimensions shall conform to the requirements of the Zoning Ordinance for the <br /> applicable zoning district within the city limits.
