e Concrete head walls, riprap and/or flume-type structures shall be required for all <br /> underground facilities. <br /> f. Bills of assurance will require the various property owners within the subdivision to mow <br /> and maintain the right-of-way and/or drainage easements adjacent to the property held by <br /> the owner upon proper notice. If the property owner does not comply with the notice, the <br /> area may be mowed by the city and the property owner billed as per the procedure on <br /> vacant lots within the city. <br /> g. All required drainage ditches shall be designed for appropriate erosion control as per the <br /> requirements of the master drainage facility plan. <br /> h. In case of open drainage within the street right-of-way, the following shall be the setback <br /> line, in feet,from the centerline of the right-of-way: <br /> Industrial street 70 <br /> Minor or principal arterial 120 <br /> Cul-de-sac 70 <br /> Cul-de-sac turnarounds 105 <br /> When street right-of-way requirements are greater than normal requirements, the building <br /> line shall be a minimum of 20 feet from the right-of-way line. <br /> • Section 15.03. 12. Hillside reeulations <br /> (a) Generally. <br /> (1) The requirements of this section are designed to ensure prior integration of physical <br /> improvements in rugged topographical areas and shall supplement requirements outlined <br /> elsewhere in this chapter. The hillside regulations shall only apply to those portions of a <br /> subdivision plat that have an average slope of 18 percent or greater. Such areas of steep slope <br /> are recognized as requiring special subdivision development standards for vehicular access <br /> easements, lot dimensions, front and side yard setbacks, and cut and fill. Hillside areas shall be <br /> reviewed based on the following objectives. <br /> (2) It shall be the purpose of the hillside regulations to promote the following city objectives. All <br /> subdivision plats submitted to the city involving hillside areas shall be reviewed based on the <br /> following objectives,which shall be considered as guidelines: <br /> a. The concentration of dwellings and other structures by clustering should be encouraged to <br /> help save larger areas of open space and preserve the natural terrain; <br /> b. To provide density and land use incentives to aid in ensuring the best possible development <br /> of the city's natural features, open space and other landmarks; <br /> c To preserve and enhance the beauty of the landscape by encouraging the maximum <br /> • retention of natural topographic features, such as drainage swales, streams, slopes, ridge <br /> lines,rock outcroppings and vistas; <br /> - 183 - Batesville Subdivision Regulations <br />
