40 . • ORDINANCE NO. 2003-11-3 • <br /> AN ORDINANCE AMENDING THE BATESVILLE ZONING CODE IN ORDER TO <br /> • COMPLY WITH ACT 624 OF 2003 ENTITLED "AN ACT TO PROVIDE FOR THE <br /> AVAILABLILITY OF AFFORDABLE HOUSING WITHIN THE MUNICIPALITIES <br /> OF ARKANSAS." <br /> BE IT ORDAINED BY THE CITY COUNCIL AS FOLLOWS: <br /> SECTION 1. The following Definitions are added to Section III, subsection II,page 8. <br /> Manufactured Home: A dwelling unit constructed in a factory in accordance with the <br /> federal standards and meeting the definitions set forth in the Act 624, of 2003 by the <br /> State of Arkansas. <br /> Mobile Home: Must have been manufactured before 1976 or before the HUD Code <br /> pertaining to manufactured homes. A mobile home is expressly prohibited by this code. <br /> SECTION 2. The Following Amendments for Section V, subsection III, (R-2 General <br /> Family) <br /> Permitted Uses: <br /> 14. Manufactured Homes as defined on page 8 may be placed in R-2 General Family <br /> Residential Districts, but only with restrictions as listed: <br /> • 1) Perimeter foundation enclosures shall be based of a permanent nature and maintained <br /> at all times. <br /> 2) Installation of a Manufactured Home shall be permanently connected to all ut�lities. <br /> 3) Construction of carports, garages, and other outbuildings shall comply with Bills of <br /> Assurances in force in a particular area of a residential district. <br /> 4) Placement of manufactured homes shall comply with all other requirements as stated <br /> in R-2 zone regulations. <br /> H. Special Provisions <br /> 1)All units constructed in or set up in this district,whether by new construction, addition <br /> to an existing unit,placement of a multi-section manufactured or modular home or <br /> combination of two or more single-section manufactured homes, shall have a minimum <br /> dimension on each side of at least 20 feet and shall correspond with general appearance <br /> of the structures in the area and/or as defined by building codes and/or restrictive <br /> covenants, ordinances, etc. Prudent/standard building practices will be exercised. <br /> 2)All units constructed or set up in this district with a crawl space shall have continuous <br /> masonry underpinning around said crawl space. <br /> • <br />
