RESOLUTION NO. 03-09-02 OF THE BATESVILLE <br /> UTILITIES COMMISSION <br /> WHEREAS, the Batesville Utility Commission, an agency of the <br /> City of Batesville charged with the duty and authority to construct, <br /> reconstruct, build, maintain and repair the water and sewer treatment <br /> plants, distribution and collection systems for the City of Batesville, <br /> Arkansas, has acquired title to lands from First National Bank of <br /> Arkansas, predecessor in interest to Bank of America. <br /> WHEREAS, the Batesville Utility Commission from time to time <br /> is donated sites or easements or both for public use for the water and <br /> sewer system at no cost or nominal cost and these donations contribute <br /> (W significantly to reductions in costs of construction, and the Batesville <br /> Utility Commission wishes to encourage donors to make such donations <br /> for public use; and, <br /> WHEREAS, the return to the grantors of these parcels, subject to <br /> easements for existing water or sewer lines, after the need for public use <br /> is ended would encourage donors to donate such sites to public use; <br /> NOW, THEREFORE be it resolved by the Batesville Utility <br /> Commission: <br /> 1. That the lands lying in Independence County, Arkansas <br /> described as follows: <br /> A tract of land being a part of the Southwest <br /> Quarter of Section 13, Township 13 North, <br /> 7p/rs <br />
