4. Which contain concentrations of waste <br />having in excess of 270 milligrams per <br />liter biochemical oxygen demand (BOD). <br />5. Which exert or cause unusual volume of <br />flow or concentration of wastes constitut- <br />ing "slugs" as defined herein. <br />Concentrations of wastes discharged to the sewer <br />system in excess of that named in Article V, Section 4(i)(3) and <br />4(i)(4) above up to 350 milligrams per liter of suspended solids <br />or 350 milligrams per liter BOD will be subject to a surcharge <br />to be assessed under a separate city ordinance. Water users <br />discharging waste in excess of 350 milligrams per liter BOD or <br />350 milligrams per liter of suspended solids must provide pre- <br />treatment to a level of 350 milligrams per liter BOD and 350 <br />milligrams per liter of suspended solids, or less, for both <br />suspended solids and BOD, unless specifically exempted by <br />separate city action. <br />SECTION II: Batesville City Ordinance No. 816 (July, <br />1972) shall be modified as follows: <br />(a) Section 2 of the aforesaid Ordinance No. 816 modifying <br />Section 3(b) of Article V of Ordinance No. 717 shall be, and is <br />hereby, modified by striking therefrom the words in the final <br />phrase of said subsection "including but not limited to cyanides <br />in excess of 0.003 as CN in the waste as discharged to the <br />public sewer". <br />The aforesaid Ordinance No. 717 shall be, and is hereby <br />restored to its original form, except for striking therefrom in <br />the final phrase of said subsection the words "including but not <br />limited to cyanides in excess of two (2) milligrams per liter as <br />CN in the waste as discharged to the public sewer". <br />(b) Section VI of Ordinance No. 816 should be, and is <br />hereby amended to substitute for Section VI of Ordinance No. 816 <br />the following section, to -wit: <br />- 2 - <br />
