Phase I Environmental Site Assessment <br />Riverside Conoco <br />1350 Myers Avenue <br />Batesville, Arkansas <br />2.0 USER PROVIDED INFORMATION <br />2.1 Phase I Environmental Site Assessment Reasoning <br />This Phase I ESA was conducted in an effort to satisfy the "all appropriate inquiries" <br />(AAI) standard for invoking landowner liability protection under the Comprehensive <br />Environmental Response, Compensation and Liability Act (CERCLA). In order to obtain <br />landowner liability protection under CERCLA, the user must meet either the innocent <br />land owner, bona fide prospective purchaser, or contiguous property owner liability <br />protection stipulations detailed in CERCLA. To qualify, the user must also perform the <br />user responsibilities listed in Section 6 as well as any pre- and post-acquisition <br />obligations contained within the ASTM E1527-21 standard. <br />2.2 Environmental Liens/Activity and Use Limitations <br />A Phase I ESA User Questionnaire provides the user the opportunity to supply the <br />environmental professional with information regarding environmental liens and activity <br />and use limitations obtained through the review of land title records and/or judicial <br />records. Mr. Tim Meitzen, Batesville City Attorney, completed a Phase I ESA User <br />Questionnaire on December 13, 2022. <br /> <br />According to Mr. Meitzen, no environmental liens have been filed or recorded against <br />the subject property. Additionally, no activity or land use limitations are in place for <br />the subject property. The completed Phase I ESA User Questionnaire is presented as <br />Appendix A. <br />2.3 Chain of Title <br />A detailed chain of title was not provided for review. <br /> <br />Independence County Tax Assessor's documents indicate the subject property (parcel <br />ID 1100482001C) is currently owned by Stroud Family Property LLC. The property <br />sales record lists the Stroud Family as the grantee of a deed transfer on December <br />22, 1999, and July 16, 2019. <br />3.0 SITE DESCRIPTION <br />3.1 Property Description <br />3.1.1 Location and Legal Description <br />The physical address for the property is 1350 Myers Avenue, Batesville, Arkansas. <br />Please refer to Figure Number 1 for a Site Location Map of the subject property. <br />6 <br />
