J. LEAVE OF ABSENCE FOR CLASS B EMPLOYEES <br /> The Mayor may grant an employee a leave of absence without pay and without <br /> benefits including paid medical insurance for a period not to exceed one (1) year <br /> when it is in the interest of the City to do so. At the expiration of the leave of <br /> absence without pay, the employee may be reinstated to any position of the <br /> same classification. An approved leave of absence shall not constitute a break <br /> of service with respect to tenure, retirement, and seniority. The employee may <br /> continue on the City's health insurance by going on Cobra at the employee's <br /> expense. <br /> K. FUNERAL LEAVE <br /> The City of Batesville will allow an employee to take up to 24 hours, with pay, <br /> when a death occurs in their immediate family with their supervisors approval. In <br /> this instance, "Immediate family" is defined as spouse, parent, child, brother, <br /> sister, stepchild, stepparent and grandchild. The Mayor may allow the employee <br /> to take additional time off if the employee must travel out of state or for other <br /> special circumstances. <br /> For the death of other family members (father-in-law, mother-in-law, brother-in- <br /> law, sister-in-law, grandparents and step-grandparents), employees will be <br /> allowed 8 hours off with pay with the supervisors approval. With the Mayor's <br /> approval, up to sixteen additional hours may be allowed. Employees will be <br /> allowed to take off the day of the funeral (8 hours pay) for other relatives such as <br /> aunt, uncle, etc. <br /> Up to four hours with pay will be allowed for an employee to serve as pallbearer if <br /> the funeral is local. The Mayor may allow additional time off with pay if the <br /> funeral is out of town. <br /> L. JURY AND WITNESS DUTY <br /> Employees will be granted leave with pay for jury duty and are permitted to retain <br /> the allowance for services from the court for such service. If an employee <br /> appears as a witness in court at the request of the City of Batesville or if an <br /> employee is subpoenaed as a witness in his capacity as an employee of the City <br /> of Batesville to testify in a matter in which the acts or omissions to act of the City <br /> are in issue shall likewise be paid for such service. Employees are also <br /> permitted to retain the allowance for services from the court for such service. <br /> If an employee is on leave with pay for jury or witness duty outside their regular <br /> work schedule, they will be paid at their hourly rate, not at overtime rate. Jury <br /> and witness duty will not be considered worked hours, and no more than 8 hours <br /> ( per day or 40 hours per week will be paid for the jury or witness duty, all at the <br /> �r employee's regular hourly rate.
